El maltrato hacia los animales

Desde que entró en vigor de la reforma del CP en octubre de 2004 se han iniciado en España 321 procedimientos sobre maltrato de animales.
.
La modificación del artículo 337 del Código Penal estipula que las penas, en caso de maltratos que causen la muerte o lesiones graves, pueden oscilar entre los tres meses y el año de cárcel, así como inhabilitación especial de uno a tres años en casos de profesiones relacionadas con los animales .
.
Pero a pesar del número de procedimientos raras veces se han impuesto penas de cárcel, normalmente sólo se aplican penas de multa. Es posiblemente la falta de conciencia social de que se pueda condenar a ir a la cárcel a una persona por el maltrato de un animal junto con la farragosa y compleja instrucción en los juicios para que se pueda demostrar con todas las pruebas aportadas los hechos denunciados, a favor lógicamente de la “presunción de inocencia” y de principios tan conocidos como “in dubio pro reo”
.
Cuando se tenga consciencia de que efectivamente se está produciendo un maltrato la sociedad tiene que denunciar y las instituciones lógicamente aplicar la ley.
¿Qué legislación podría aplicarse en relación con los
animales?
Haciendo un breve resumen:
.
1.- Declaración de los "Derechos del Animal" adoptada por la Liga Internacional de los Derechos del Animal, aprobada en París el 15 de Octubre de 1978 bajo el patrocinio de la UNESCO.
.
Contiene una serie de derechos que podemos citar:
.
• Todos los animales son iguales ante la vida y tienen el mismo derecho a la existencia.
• No se someterá a ningún animal a malos tratos ni actos crueles.
•Todo animal perteneciente a una especie que vive tradicionalmente en el medio ambiente humano tiene derecho a vivir y a crecer al ritmo y en las condiciones de vida y libertad propias de su especie.
• El abandono de un animal es un acto cruel y degradante.
• La experimentación animal que entrañe un sufrimiento físico o psicológico, es incompatible con los derechos del animal, ya se trate de experimentación médica, científica o comercial, o de cualquier otra forma de experimentación.
•Los organismos de protección y salvaguardia de los animales han de estar representados en el ámbito gubernamental.

2 .-Código Penal: “Delitos contra los recursos naturales y medio ambiente”, “Delitos a la protección de la flora, fauna y animales domésticos” y como falta en los arts. 631 P y 632 CP (“Faltas contra los intereses generales”
• Si vemos la evolución en el CP es cierto que ha habido un endurecimiento de las penas desde la Reforma LO 15/2003, de 25 de noviembre.

• o Real Decreto de 25 de Mayo de 1985 de Importación exportación. Control por Centros de Inspección de Comercio Exterior de productos afectados por la Convención sobre el comercio internacional de especies amenazadas de fauna y flora silvestres
• o Ley 4/89, de 27 de Marzo, de Conservación de los Espacios Naturales y de la Flora y Fauna Silvestre
•o Real Decreto 439/90, de 30 de Marzo, por el que se regula el Catálogo Nacional de Especies Amenazadas
• o Real Decreto 873/90, de 6 de Julio, por el que se establece un régimen de ayudas para actividades privadas en materia de conservación de la naturaleza

- Caza y pesca:

• o Ley de 19 de Septiembre de 1896, para la protección de los pájaros insectívoros
• o Ley de 20 de Febrero de 1942, por la que se regula el fomento y conservación de la pesca fluvial. Modificada por la Ley de 16 de Julio de 1949, la Ley de Mayo de 1948 y la Ley de 31 de Mayo de 1966.
• o Reglamento para la aplicación de la Ley de pesca fluvial, aprobado por Decreto de 6 de Abril de 1943
• o Ley de 31 de Diciembre de 1946 sobre represión de la pesca con explosivos o sustancias venenosas y corrosivas o Ley 1/70, de 4 de Abril, de caza y su correspondiente Reglamento (Decreto 506/1971, de 25 de Marzo)
• o Real Decreto 1095/89, de 8 de Septiembre, por el que se declaran las especies objeto de caza y pesca y se establecen normas para su protección
• o Real Decreto 1118/89, de 15 de Septiembre, por el que se determinan las especies objeto de caza y de pesca comercializables y se dictan normas al respecto

- Protección de animales utilizados para experimentar y para otros fines científicos:

• o Real Decreto 223/88, de 14 de Marzo, sobre protección de los animales utilizados para experimentación y otros fines científicos
• o Orden Ministerial de 13 de Octubre de 1989, por la que se establecen las normas de registro de los establecimientos de cría, suministradores y usuarios de animales de experimentación de titularidad estatal, así como las de autorización para el empleo de animales en experimentos, en desarrollo del Real Decreto 223/88 de 14 de Marzo

- Normas relativas al transporte internacional de animales:

• o Ley de Epizootias, de 20 de Diciembre de 1952 y su Reglamento de 4 de febrero de 1955
• o Orden de 29 de Octubre de 1987, Protección de animales. Normas relativas al transporte internacional

4.- Legislación autonómica, hay numerosa, a modo de ejemplo podemos citar:
- Ley 3/88 de 4 de Marzo (Parlamento de Cataluña) de protección de animales y plantas
- Ley 1/90, de 1 de Febrero, (Asamblea de Madrid) protección de animales y plantas. Protección de animales domésticos
.
5.- A nivel comunitario numerosas directivas y recomendaciones al respecto. (por ejemplo: 86/609 CEE : Directiva del Consejo, de 24 de Noviembre de 1986, relativa a la aproximación de las disposiciones legales, reglamentarias y administrativas de los Estados miembros respecto a la protección de los animales utilizados para experimentación y otros fines científicos)
.
Finalmente tenemos que destacar que con fecha de 26 de enero de 2007 se aprobó en el Consejo de Ministros el Proyecto de Ley sobre protección de los animales de producción y de los utilizados para experimentación y otros fines científicos que incorpora al ordenamiento jurídico aspectos de la legislación comunitaria en materia de protección animal. El ámbito principal de aplicación afecta a las explotaciones ganaderas, al transporte y al sacrificio, así como a las actividades de experimentación con animales. Pero a pesar de que la normativa se refiere a animales mantenidos con fines económicos, se extiende a los animales de compañía..
.
Se establecen las condiciones mínimas para la cría, mantenimiento y utilización de animales de experimentación, así como el uso de determinados tipos de animales como perros y gatos vagabundos, y extiende la prohibición del maltrato, el abandono o la utilización de animales en peleas a los de compañía.
.
Establece para los propietarios y criadores de animales en las explotaciones la obligación de asegurar su protección, cumpliendo la normativa sobre las condiciones en que se crían y mantienen, tomando en cuenta su especie y grado de desarrollo, adaptación y domesticación.
.
Fija los requisitos y las condiciones en los medios de transporte, y aspectos relativos a las empresas transportistas, como su autorización y registro y la formación del personal en materia de protección animal.
.
El Proyecto de Ley contempla la posibilidad de adoptar medidas provisionales cautelarles en casos de grave riesgo para la vida de los animales y tipifica infracciones, clasificándolas como leves, graves o muy graves, dependiendo de los criterios de riesgo o daño para los animales y de la intencionalidad de las mismas.
.
Las sanciones a aplicar van desde un mero apercibimiento hasta con multas que pueden oscilar entre los 600 y los 100.000 €. Además se modifica la ley de sanidad animal para prever, en la imposición de las sanciones por la comisión de infracciones, la posibilidad de una graduación más proporcional, teniendo en cuenta los casos en los que existe una cualificada disminución de la culpabilidad del imputado.
.
Se prohíbe la publicidad con animales de forma indebida y se contempla el establecimiento, por parte del Ministerio de Educación y Ciencia, de un procedimiento excepcional para la acreditación de la formación y experiencia de los investigadores que trabajan con animales de experimentación.
.
Por último, con este Proyecto de Ley se crea un tasa para compensar los gastos que se derivan del cumplimiento por parte de España del Convenio.
.

Pero a pesar de la regulación existente y la tendencia hacia el endurecimiento de las sanciones habría que hacer hincapié en una mayor sensibilización y concienciación social a la hora de tener un animal en casa, que no se trata de un juguete sino de un ser vivo.

Issues to consider when adopting a pet

A pet may be more expensive than you think. Be realistic about how much you can afford. Here's a run down of start-up expenses relating to different pets:

Amphibians, reptiles, and fish: Aquarium, filter, heater, plants, owner's manual.
Birds and rodents: Cage, bedding or cage liner, dishes, toys, owner's manual.
Dogs and cats: License, collar, leash, brush, toys, dishes, bed, owner's manual.

Here are some other ongoing costs to consider:

Regular well-pet veterinary care
Sick, trauma, or emergency veterinary care
Vaccinations and other medical care as needed

Do you have the time and energy to feed, clean or groom, handle, train, exercise, and take your pet to the veterinarian regularly? Here's a run down of minimum time needed to provide basic care for a pet:

*Amphibians, reptiles, and fish
10 minutes per day, plus 3 hours every few weeks
*Hamsters, mice, guinea pigs, and rabbits
30 minutes per day
*Cats and birds
30 to 60 minutes per day
*Dogs
More than one hour per day

Remember that these times are bare minimums, and all pets deserve to be in a loving home with people who have the time and energy to take care of them and spend time building the special bond.

Training Your Puppy

Who can fathom the mind of a puppy? Squirrels drive them crazy, garbage is their favorite snack and immediately after chewing your one-of-a-kind, handmade leather jacket into confetti, they can give you a look of such innocent love and adoration that you forget all about it. This kind of behavior can baffle and frustrate even the most conscientious of dog owners. When you bring a puppy home, she becomes part of your family; you need to be able to trust her with your home, your belongings and even your children. Managing your puppy's behavior is the key to having a peaceful and loving relationship with her.
.
To have a dog that makes a good, dependable companion, you're going to have to spend time training them. There's no other way for your puppy to know that chewing on an old knotted sock is acceptable, for example, while chewing on the sofa is not. She needs to be taught appropriate behavior calmly, gently, and--most important--consistently. As soon as you get your pup, you can start teaching her how to listen to you, how to act around people and other dogs, and generally to be the best-behaved dog ever.

The Alpha Owner
.
Though we'll never know exactly what your pooch is thinking when she chases her tail until she gets dizzy, we do have some insight into how dogs think about relationships. Wild dogs live and hunt in packs. This is an important model, because in every pack there are structured power relationships between members. The alpha dog is the provider for the pack. In a pack, nothing is given to a dog without performing a task. If a dog learns that they can jump up on the couch when they want, drag you down the street on the leash and get treats when they beg for them, they may decide that they are running the show. Puppies who are given everything for “free” will start to demand things and this can lead to aggression issues. They may start ignoring commands, jumping up where they're not supposed to jump, and protecting their food or their "territory" with growls. In extreme cases, they can begin biting.

In order to have a peaceful, manageable relationship with your dog, it's important that you establish the position that all humans are higher up in the hierarchy than them in the beginning. Do not use physical intimidation to establish human hierarchy. Physical intimidation can leave a dog feeling threatened and defensive, and may even provoke an attack. You don't need to raise your voice either; shouting can also make dogs nervous and provoke aggression.
.
Aggressive displays of dominance aren't necessary. Most dogs are perfectly happy submitting to a leader; they actually gain confidence and a sense of security from having someone to follow. A good pack leader projects a sense of strength by using a steady voice and reacts calmly to situations that make the dog nervous. The successful pack leader also provides food, shelter, and attention to the dog when she behaves appropriately. Having her repeatedly follow your commands (sit, stay and lie down) reinforces your position above her in the hierarchy. If you're still having a hard time, ask your veterinarian about special exercises designed to establish your position in the hierarchy.

One of the main ways to develop your position in the hierarchy is to start the “nothing in life is free” training. This means that once a dog has mastered a skill (like sitting or lying down) they must perform that skill to get something she wants. For example if your dog wants to go for a walk she must sit before you put her leash on. If your dog wants to be fed she must sit and stay until the bowl is put down and you have given her permission to go to the bowl is another example. Making your dog work for all of the things that she wants will help teach her that you are the leader and that listening to you will lead to rewards. It is very important that the dog has mastered the skill and knows what you want before you start the “nothing in life is free” training.

The Social Life
.

Socializing is one of the most important things you can do to train your young dog. Puppies are like sponges--ready to absorb all kinds of information about their world. In the first months of their lives, it's your job as a pet owner to teach them to bond with people and with other dogs and to be comfortable in unfamiliar situations. This is one of the most important things you can do for your fuzzy friend. The less afraid your puppy is of strange people and animals, the less likely she is to act defensively and attack another dog or even a child.
.
The socialization of puppies begins between three and four weeks of age (before most people bring their new pets home). This means that some of the work is left up to the puppy’s mother. If your puppy has been raised by a careless owner or breeder, you may have an uphill battle to fight when you get her home. Luckily, your puppy will continue the socialization process until she is about 12 weeks old, so you have plenty of time to give her good experiences. First of all, make sure she bonds with you and your family. Show her that she can depend on you for affection, food and gentle leadership. Between the age of 8 and 12 weeks is the perfect time to enroll your puppy into puppy classes. Puppy preschool will help socialize your pup with other puppies in a safe environment. Most puppy classes will require that your puppy has their first set of vaccines.

Once your pup feels safe with you and she's had all her vaccinations, you can introduce her to the big, wide world. Take her to lots of new and exciting places--the park, a friend's house or dog-friendly stores. Make sure she has plenty of chances to meet kind people and play with well-socialized dogs. Try to make trips to the veterinarian fun, with plenty of petting from you and the friendly veterinarian and technicians. It may be wise to withhold food for a couple of hours prior to a visit to the veterinarian so that they will be hungry and will want to eat treats given by both you and the veterinary staff. Introduce her to children, in a well-supervised environment. Show the kids how to speak calmly to her and pet her gently.

If your puppy acting nervous in a new situation or starting to bristle at a strange dog, try not to scold her. Raising your voice will only make her tenser. Trying to comfort her will backfire too. If she gets a lot of petting, cooing and attention every time she's scared or aggressive, she'll learn that reacting this way is a good thing. Instead, remain call and talk to her in a steady voice that is reassuring but not coddling. Try to focus her attention on something else. Toss a ball or a chew toy to her, or start playing her favorite game. When she gets absorbed in the game and starts ignoring the people or the dog that scared her, give her lots of praise. It is important to take your time and don’t push your puppy into situations where they are scared. Be patient, it may take several tries before she is fully ready to take on the scary situation. Baby steps will move you slowly to your goal. Soon she'll associate the scary situation with fun and playtime, and she'll become a canine socialite.

Think Positively
.
When most dog owners think about training their dog, they think in negatives. They want their puppy not to chew the furniture, not to piddle on the carpet and not to jump up on guests. This can get a little confusing from the puppy's point of view. Imagine you were a puppy home alone and you spent most of your day chewing on some loafers and spreading garbage around the kitchen. Then you nap for an hour and meet your family at the door when they come home. Suddenly they greet you with lots of yelling of "No!" What did you do wrong? Was it the chewing or meeting the family at the door? What were you supposed to do instead?
.
The key to keeping your puppy from doing what you don't want her to do is giving her a positive alternative--teaching her what you do want her to do. It is much easier to teach everything she can do rather than try to teach her everything she cannot do. For example, if you see your puppy dancing anxiously around the living room like she needs to go out, quickly let her outside. Stay near her the whole time she's out, and reward her with praise and a treat as soon as she relieves herself. This teaches her that going outside is a good thing. If you catch your puppy having an accident on the rug it is important to get her attention and take her outside immediately. Praise her when she goes potty outside. If you catch your puppy chewing on something you don't want her to chew on, distract her with one of her "good" chew toys. Whenever you catch her chewing on one of her toys, reward her. The key to effective training--try to catch your puppy doing something good, like sitting still instead of jumping up or sleeping on the floor instead of the bed. Make a point of noticing these behaviors and rewarding them with attention, praise or treats.

Training is a gradual process and it can be a difficult road to walk alone. It's vital that your entire family agrees and commits to a training plan that you all respond the same way when your dog misbehaves as well as when she behaves perfectly. Remember to be persistent and above all, patient. Your puppy's going to make a lot of mistakes and may destroy a few of your belongings. However, she is eager to please you. She needs your love, attention and guidance to be the good dog you know she can be.

Perros de rastreo

.
Los perros de rastreo, también conocidos como perros de rastro, siguen el olor de las personas perdidas. Estos perros son capaces de seguir el rastro de una persona porque han sido entrenados para discriminar olores. En otras palabras, no buscan cualquier olor humano, sino un olor en particular.
.
Existen dos tipos principales de actividades de rastreo: el rastreo en áreas silvestres y el rastreo en zonas urbanas.
.
Normalmente, la búsqueda en zonas urbanas suele ser más difícil para los perros porque en estas zonas existe mucho tráfico de personas, mascotas y automóviles. Además, el cemento y el pavimento tienden a conservar los olores por menos tiempo que las superficies naturales. Finalmente, puede haber una gran cantidad de personas y automóviles circulando mientras el perro está rastreando, lo que dificulta la búsqueda.
.
Por su parte, la búsqueda en áreas silvestres es más amigable para los perros ya que las zonas son menos transitadas y las superficies naturales suelen retener mejor el olor de la persona buscada. Además, las superficies naturales proporcionan una segunda fuente de información para los perros que es el olor de contacto.

Dado que los perros de rastreo discriminan olores, necesitan dos cosas para empezar a rastrear:- Un punto de partida, también conocido como el "último punto en que se vio a la persona" (PLS por sus siglas en inglés)- Una muestra no contaminada del olor de la persona El "último punto en que se vio a la persona" no es necesariamente el último punto en que realmente se vio a la persona, sino el último punto desde el que se puede iniciar la búsqueda.
.
La muestra no contaminada de olor es cualquier artículo que tenga el olor de la persona perdida. Las fuentes de almohadas y los pijamas suelen ser excelentes muestras de olor, pero otras prendas de vestir y otros artículos pueden ser igualmente útiles. Es muy importante mantener esta muestra sin contaminar, por lo que se usan pinzas para manejarla y bolsas Ziploc o bolsas marrones de papel para transportarla (las bolsas comunes de basura no sirven porque son tratadas químicamente para alterar los olores).
.
Generalmente, los perros de rastreo trabajan sujetos a una correa larga (de unos 10 metros) que se une a un arnés. Sin embargo, esto no es obligatorio y existen perros de rastreo que trabajan sin estar sujetos a la correa. Aunque cualquier perro saludable puede entrenarse como perro de rastreo, el Bloodhound es la raza preferida para esta actividad.Olfateando insectos aplastados El olor de contacto es el olor (y posiblemente también algo de información visual) generado por la distorsión del ambiente cuando la persona camina. Por ejemplo, el olor de las ramas rotas o de insectos aplastados.

Aunque los perros de rastreo no pueden seguir una pista sólo por el olor de contacto, los expertos creen que este olor puede proporcionar información adicional (quizás también información visual) en las circunstancias apropiadas.
